Dubbed “the dean of American antitrust law” by the New York Times, Herbert Hovenkamp is almost universally recognized as the most cited and the most authoritative US antitrust scholar. Not only is Herb a walking encyclopedia of case law and commentary on all antitrust subjects, his insights and observations have guided practitioners, academics and courts alike as our court-made antitrust law and policy has evolved. Herb is always at the front of the curve in understanding where the law is headed, and why, as well as whether it is a good thing for consumers and other constituents. He also thoroughly understands that antitrust law can easily lose its way if it becomes politicized or untethered to fundamental guiding principles, even if those too may evolve. And perhaps most importantly, Herb is a wonderful and accessible person, and has been ever since I first reached out to him many decades ago as a young lawyer trying to understand the nuances of antitrust.

Herb Hovenkamp came by the title, Dean of American Antitrust Law, in all the right ways. He collaborated with the prior Dean, Phillip Areeda, on the leading antitrust treatise and then, after Phil’s death, distinguished himself on his own. He not only updated and expanded the treatise with new volumes but wrote numerous articles on virtually every aspect of antitrust law. Those articles, like the treatise, are marked by their precision, their comprehensiveness, and their common sense. Together, they have exerted an enormous influence on the development of antitrust law. This book is an interesting and well-deserved recognition of Herb’s achievements.
